Information that we collect from you
When you visit, register or order products or services on the Websites you may be asked to provide certain information about yourself ("personally identifiable information") so that we can provide you with a particular service. We have implemented technical, managerial, and operational security, rules, procedures and measures, to ensure that your personal information is held within operating environments that are not available to the public. We take steps to guard against unauthorized access, improper use, alteration, destruction, and accidental loss of personal data. This includes rules for all our staff with access to the servers or databases that hold your personal information. Although we make every effort to create a secure environment for your personal information, we cannot guarantee the safety of any personal information you transmit to us online.
Securing the Transmission and Storage of Information
We treat the information you provide to us as confidential information; it is, accordingly, subject to our company's security procedures and corporate policies regarding protection and use of confidential information. When we ask you for credit card data it is transferred over a Secured Sockets Layer ("SSL") line provided you are using a SSL enabled browser such as Microsoft Internet Explorer or Netscape Navigator. This secure mode is enabled before any such information is transmitted from your computer. After information reaches us it is stored on a secure server that resides behind firewalls designed to block unauthorized access.
Disclosure of Information to Third Parties
The Dorchester Collection uses the services of third parties, such as e-mail service providers and marketing companies that act as agents on its behalf. These parties are contractually prohibited from using personally identifiable information for any purpose other than for the purpose the Dorchester Collection specifies. In addition, we may disclose your personally identifiable information to successors in title to our business. We do provide non-personally identifiable information to certain service providers for their use on an aggregated basis for the purpose of performing their contractual obligations to us. We prohibit the sale or transfer of personal information to entities outside of the Dorchester Collection for their use without your approval.
Cookies
Our Websites use "cookie" technology. "Cookies" are encrypted strings of text that a website stores on a user's computer. Our Websites require the use of a cookie throughout the online reservation process. Without cookies we will not be able to keep information you enter on multiple pages together. For example, unless our Websites can remember the dates you used in your hotel search we will not be able to check room availability.
The types of cookies that we use are referred to as "session" cookies and "persistent" cookies. Session cookies are temporary and are automatically deleted once you leave our Websites. Persistent cookies remain on your computer hard drive until you delete them. We do not use cookies to gather information concerning your visits to other sites, nor ascertain any personally identifiable information about you apart from what you voluntarily provide us in your dealings with us. Cookies do not corrupt or damage your computer, programs, or computer files.
In addition, the service providers we use to serve and host our advertisements, and/or deliver our e-mails, use session and persistent cookies, to track the number of times our Websites are accessed and whether the sites were accessed from an advertisement. Sometimes cookie technology is used to track the number of times an advertisement is viewed. In all cases, the cookie generated from the advertisement or e-mail does not contain any personally identifiable information and will remain on your hard drive until you delete it.

Pixel Tags
The Dorchester Collection and its third party service providers use pixel tags (also known as "clear gifs", "beacon gifs", etc.). Pixel tags are not visible to the user of the Websites and consist of a few lines of computer coding. Pixel tags are not used to collect any personally identifiable information about you apart from what you voluntarily provide to us. The Dorchester and our e-mail service provider use pixel tags to track responses to advertisements and website content and to determine your ability to receive HTML-based e-mail messages. Our e-mail service provider includes a pixel tag, which they refer to as a "coded sensor", in all of the HTML-based messages sent on our behalf. The sensor activates when the e-mail message is opened and flags the e-mail address of the user as one that is capable of receiving HTML-based e-mail messages. This capability helps our service provider to send the e-mail in a format you can read. The sensor does not collect or use any other information. If you cannot receive HTML, you will not receive a functioning sensor.
E-Mails about Special Offers, Promotions and Future Events
It is our intention to send you only e-mail communications that will be useful to you and that you want to receive. We may periodically contact you via e-mail and provide information about special offers and promotions that may be of interest to you. We use a third party e-mail service provider to send e-mails. This service provider is prohibited from using your e-mail address for any purpose other than to send e-mail relating to our products and services. Return Policy
At The Beverly Hills Hotel, we are committed to offering our customers the highest quality products. If you are not completely satisfied with your purchase, simply return the merchandise to us along with the receipt within 30 days following the instructions below:
Contact The Beverly Hills Hotel Customer Care to obtain a return authorization number. Call 310-281-2952.
Please pack the merchandise carefully in the original packing material and return it to the address printed on your packing list. All returned items must include a return authorization number and be in good condition. The Beverly Hills Hotel is not responsible for incorrectly packaged items that are returned to us and we cannot provide a refund for items returned in poor condition.
The hotel cannot refund shipping and handling.

TERMS AND CONDITIONS RELATING TO SALES OF PRODUCTS
Contract
You will indicate by completing the appropriate order form on the Site the products that you wish to order. At the same time you will complete an authorization for us to recover, through your credit or debit card, payments due to us.
Your order shall constitute an offer to us to purchase the Products specified in the order. We may accept or decline the order. If we acknowledge your order that shall not constitute an acceptance of it. If we accept the order we shall notify you of our acceptance (in these Terms "Acceptance") by email, and we shall confirm the price. We shall at the same time notify you of the identifying number (in these Terms the "Order Number") for your order and you will be required to quote it in any subsequent communications. Only at that point will a contract for the sale and purchase of Products come into being.
The Beverly Hills Hotel reserves the right in its discretion to decline to accept any order and/or to supply Products to any individual or company. If we decline to accept, or cancel, an order for which we have received payment, we shall refund the payment, but shall have no further or other liabilities.
Entire Agreement
Each order, Acceptance of each order and the supply of Products by The Beverly Hills Hotel pursuant to an order shall be governed by these Terms. These Terms constitute the entire understanding between you and The Beverly Hills Hotel in relation to any Products ordered and supplied through the Website. They supersede any other terms stipulated by you, whether in any order or during negotiations or any course of dealing established between you and us.
All descriptions, illustrations and indications or price of Products provided on this Website or otherwise communicated to you are for guidance only and intended merely to present a general idea of the Products. Nothing contained in any such description, illustration indication of price shall form any part of these Terms.
Price
The prices of the Products shall be those specified by The Beverly Hills Hotel to you from time to time in accordance with the provisions headed "Orders and Contracts" above. Prices quoted on the Website are indicative only and are subject to change.
All prices on the Website are inclusive of United Kingdom VAT and exclusive of postage and packing.
Prices on the Website may differ from those in The Beverly Hills Hotel stores.
Delivery and Availability
The Beverly Hills Hotel shall deliver Products ordered by you to a courier or postal service of The Beverly Hills Hotel choice to the delivery address that you have given us. By accepting these Terms, you agree irrevocably to appoint and do appoint the courier or postal service to be your agent for taking delivery of the Products on your behalf, and delivery to the courier or postal service shall be deemed to be delivery to you.
If you are resident in the UK, The Beverly Hills Hotel shall wherever applicable, instruct the courier or postal service to deliver the Products to the address in the UK that you give us.
All delivery is subject to availability and time shall not be of the essence. We have indicated on the Website whether or not a Product is currently "in stock" (i.e. available in our warehouse for dispatch) or our estimate on when the Product will be available for dispatch. However, this is an estimate only, should not be relied upon and may be subject to change. If there is any delay, will notify you of this and give you a new delivery time. As we process your order, we will also notify you if any Products unfortunately are not available.
If you are a Consumer (i.e. a natural person who, in contracts to which the Consumer (Distance Selling) Regulations 2000 apply, is acting for purposes that outside his or her business), The Beverly Hills Hotel shall endeavour to deliver Products ordered by you within seven (7) working days of the day of receipt of your order. If delivery within seven (7) working days is not possible The Beverly Hills Hotel shall notify you of the delay and give you a new delivery time.
Children
The Beverly Hills Hotel does not sell product for purchase by children. If you are under 18, you may use this Website only with the involvement of a parent or guardian.
Inspection, Delivery Delays and Non-Delivery
Nothing in this clause affects your statutory rights pursuant to the provisions headed "Right to Cancel and Returns" below.
You must inspect the Products as soon as is reasonably practicable after delivery. Within fourteen (14) working days of delivery you shall notify The Beverly Hills Hotel in detail and in writing of any defect in the Products or of any other complaint that you may have in relation to the Products. If you fail to give notice in accordance with this clause, the Products shall be conclusively presumed to be in all respects in accordance with the order and free from any defect that would be apparent on reasonable examination, and you shall be deemed to have accepted the Products accordingly.
Subject to the conditions set out below, if you establish to our reasonable satisfaction that any Products are not in accordance with these Terms or any other contract between us or are defective, your sole remedy shall be limited (as The Beverly Hills Hotel may elect) to the replacement of the Products or refund to you of the purchase price and any delivery costs or, where sums are owed by you to us, the issue of a credit note or a credit card account refund against return of the Products. If we require you to return the Products to us and they are defective we shall reimburse your reasonable postage cost of returning them. These remedies are subject to the following conditions:
the claim is made in writing to The Beverly Hills Hotel within three (3) months after Acceptance, or such other period as may be indicated by us for specific Products from time to time;
the Products or parts to which the claim relates are returned to The Beverly Hills Hotel within that period suitably packaged and carriage-paid and, where relevant, in accordance with any particular instructions that we may have notified to you at the time of supply. Returned Products or parts must be accompanied by an advice note stating the Identifying Number and the nature of any claimed defect, together with such further information as The Beverly Hills Hotel may at the time of supply have stipulated.
You shall make any queries regarding shortages of Products by reference to the Acceptance:
within seven (7) working days of the date of the Acceptance;
in writing; and
quoting the Identifying Number.
Queries regarding Products where we notify you of dispatch but they are not received by you must be made within seven (7) working days of the date of Acceptance, and the Identifying Number must be quoted. Without prejudice to the provisions under the headings "Passing of Risk and Property" and "Liability" and the force majeure provisions below, The Beverly Hills Hotel need not entertain any query made thereafter.
Passing of Risk and Property
Risk of loss or damage to, and title to, the Products shall pass to you at the time of delivery of the Products to the courier or postal service as described under "Delivery" above.
Right to Cancel and Returns
If you are wishing to return Products because they are faulty please see the "Inspection, Delivery Delays and Non-Delivery" paragraph above. You may also return any Products within fourteen (14) days of receipt for whatever reason. Further details of your right to cancel are given in the e-mail confirming your order.
In addition to your right to return Products within 14 days, if you are a Consumer (i.e. a natural person who, in contracts to which the Consumer (Distance Selling) Regulations 2000 apply, is acting for purposes that outside his or her business), you have the right to withdraw from your purchase within seven (7) working days of the date the Product is delivered. All customers who cancel under this statutory "cooling off period" shall be entitled to a full refund. Any customers who would like to cancel an order pursuant to this statutory right should contact our customer services team by contacting our customer services team (see "Customer Services" below for contact details).
If you would like to return any Product which is not defective in accordance with this clause, please note that we will not refund any delivery costs paid by you as part of your initial order.

Liability
